Terms and Conditions

These Terms and Conditions (hereinafter "Terms") govern the use of the platform Donaboon (hereinafter "we", "us", "our") and the digital service donaboon.org, which allows users to create projects and sell related digital products.
By using Donaboon, owned by VÂNĂTOR DE SOARE SRL, you agree to these Terms. If you do not agree with them, please do not use the platform.
1. Purpose of the Platform
Donaboon is a service for creating projects and selling digital "support products".
When creating a project, the system automatically generates a digital product that other users can purchase. Purchasing such a product grants the buyer the status of a project supporter.
Important: Donaboon is not a charity, donation, or project platform. All transactions are commercial and relate to digital goods.
The platform performs basic content moderation but does not control the actual realization of authors' projects.
2. User Accounts
The user undertakes to:
- Provide accurate and up-to-date information.
- Maintain the confidentiality of their password.
- Not transfer access to their account to third parties.
We may suspend or delete an account in the event of:
- Violation of these Terms.
- Suspicion of fraud.
- Illegal activity.
- Request by government authorities.
3. Purchases of Digital Products
- Refund Policy: All purchases are final and non-refundable, as the digital good is considered delivered at the moment of successful payment.
- Processing: Payment is processed via Stripe.
- Settings at Purchase: Before purchasing, the user may choose to: 1. Display their name publicly. 2. Or remain anonymous.
4. Public Display of Purchases
If you make a purchase public, your name or nickname may be displayed in the list of supporters. You can hide your purchase at any time by contacting support.
5. User Generated Content (UGC)
Authors are fully responsible for the content they create, upload, and publish.
We reserve the right to remove materials that:
- Violate the law.
- Violate Stripe rules.
- Contain pornography, violence, dangerous materials, or fraudulent schemes.
- Contradict our internal policies.
6. Author Responsibility for Digital Products
Project authors are responsible for:
- The quality and functionality of their digital products.
- The accuracy and correctness of descriptions.
- The fulfillment of stated promises.
Donaboon performs basic moderation but does not guarantee the fulfillment of authors' promises and bears no responsibility for the interaction between the author and the buyer.
7. Payments, Fees, and Taxes
- All payments are processed by Stripe.
- Stripe fees and Donaboon fees may be applied automatically.
- Authors are solely responsible for paying taxes related to their income.
8. Payouts to Authors
Payouts to authors are made via Stripe in accordance with Stripe rules.
Stripe may:
- Delay payouts.
- Request additional documents.
- Conduct audits.
- Block transactions if risks are detected.
Donaboon may also temporarily withhold payouts in cases of violations or internal investigations.
8.1 Use of Stripe Connect
To create projects and receive payouts, the author must:
- Create a Stripe Connected Account via Stripe Connect.
- Successfully complete all Stripe verification procedures (KYC / KYB).
The Donaboon Platform:
- Only initiates the creation of the Stripe Connected Account.
- Does not collect or process documents for identity or business verification.
- Is not responsible for Stripe verification denials, delays, blocks, or document requests.
All issues related to Stripe onboarding fall under the jurisdiction of Stripe and its policies.
If a user cannot successfully complete Stripe Onboarding, they will not be able to create projects, receive payouts, or use author features.
9. Prohibited Activity
The following is strictly prohibited on the platform:
- Illegal goods or services.
- Pornography and explicit content.
- Misinformation, violence, hate speech.
- Fraud and pyramid schemes.
- Sale of personal data or accounts.
- Copyright infringement.
- Attempts to circumvent platform security systems.
Any activity that contradicts the Stripe Acceptable Use Policy (AUP) is also prohibited.
10. Limitation of Liability
The Donaboon service is provided on an "as is" basis. We are not liable for:
- Technical failures and temporary unavailability of the service.
- Failures or actions of the payment system Stripe.
- Unauthorized access by third parties (hacking).
- Actions of authors or buyers.
- Any consequences of interactions between users.
11. Our Obligations
We guarantee that:
- All payments are secured at the level of Stripe security standards.
- We use modern technologies for data security.
- We comply with GDPR regulations.
- We ensure the operation of the platform within technical capabilities.
- We provide support to users.
12. Personal Data Processing (GDPR)
We process personal data in accordance with applicable EU legislation. Details of data collection and processing are contained in our Privacy Policy.
13. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including: war, natural disasters, massive technical problems of the global network, cyberattacks, internet infrastructure failures, or actions of government authorities.
14. Termination of Access and Account Deletion
We reserve the right to block an account without prior notice in the event of:
- Violation of these Terms.
- Conducting illegal activity.
- Fraud.
- Substantiated complaints from other users.
- Requirements of law enforcement or government authorities.
15. Governing Law and Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of Romania. All disputes arising in connection with these Terms shall be resolved in the appropriate court in Romania.
